For a potential restart of operations at the facility, the company has to ensure that violations would not reoccur, by implementing stricter air-quality monitoring mechanisms.

SEATTLE (Scrap Monster): A Land Court judge in Boston has ordered a Brayton Point scrap metal operation to shut down within two weeks. This follows complaints of release of toxic metal dust and fumes from the plant.
It must be noted that Brayton Point LLC, operated by New Jersey-based Eastern Metal Recycling was ordered to shut down its operations twice in 2020 by the zoning board of appeals. However, the company appealed the decision and submitted fresh plan to ensure better control of industrial waste, which was approved by the building inspector.

The defendants in the civil trial were Nicole McDonald, a Somerset resident and Fall River criminal defense and litigation attorney and Nancy Thomas and Kathleen Souza- two residents who live nearby Brayton Point. The defendants alleged that the industrial scrap metal dumped from trucks into piles and later loaded into freighters results in huge volumes of airborne dust.
For a potential restart of operations at the facility, the company has to ensure that violations would not reoccur, by implementing stricter air-quality monitoring mechanisms. It would require approval from the town’s zoning board of appeals. The neighbours expressed cautious optimism on potential restart of operations.
