Lawsuit by Scrap Metal Recycler Accused Delay in Final Permit

SEATTLE (Scrap Monster): A scrap metal recycling facility on the southeastern region of Chicago has filed a lawsuit against the city of Chicago. Chicago-headquartered Southside Recycling, in the federal lawsuit, has sought a court order directing the city to issue final permit to the facility.

According to the lawsuit, the city has failed to timely issue the last permit needed for the facility to begin operations. This is despite acknowledging that the company has satisfied all the requirements laid out by the City authorities. The recycler has been waiting for the Chicago Department of Public Health (CDPH) large recycling facility permit for a long time. The lawsuit also claims damages in excess of $100 million from the City.

The lawsuit was filed by Southside Recycling and its parent company RMG Investment Group LLC in U.S. District Court in Chicago against the city of Chicago and Allison Arwady, commissioner of the Chicago Department of Public Health. It alleges that the City broke the agreement made with the company in 2019. By not issuing the permit and not providing clear and honest messaging about the timing and process, the City has caused significant and potentially permanent damage to the business, it claimed.
