Greenpeace Filed Lawsuit Against Walmart's False Plastic Recycling Labels

SEATTLE (Scrap Monster): Greenpeace- the leading environmental group has filed a lawsuit in California’s Alameda County Superior Court, accusing Walmart of using false plastic recycling labels. The lawsuit was filed on Dec. 14.

In the lawsuit, Greenpeace seeks to remedy Walmart’s unlawful, unfair, and deceptive business practices with respect to the advertising, marketing, and sales of plastic products or plastic packaging that are made from plastics No.3-7, that are sold under its own private label brands and labelled as recyclable. The above products are advertised, marketed and sold as recyclable. However, they are not recyclable as there exists no recycling program that accepts these products from consumers.

Greenpeace alleged that the environmental marketing claims made by Walmart are false, misleading and deceptive. The labelling is in clear violation of California consumer protection laws, including the California Environmental Marketing Claims Act (EMCA). It urged the court to compel Walmart to change its labelling. In addition, Walmart should undertake a corrective advertising campaign, admitting that the earlier recyclability claims by it were false.

However, Walmart spokesperson said that the allegations were reviewed and explained to Greenpeace and that the company will defend itself.
