SEATTLE (Scrap Monster): Merrill, Wisconsin-based Kevin Shibilski, former Chief Executive Officer of 5R Processors, Ltd. has been indicted on federal criminal charges, says a recent press release from the U.S. Attorney’s Office for the Western District of Wisconsin. His arraignment has been scheduled for Oct. 6.
The indictment alleged that Shibilski stored and disposed of broken and crushed glass from cathode ray tubes (CRTs) at facilities in Wisconsin and Tennessee. It also charges him with eight counts of wire fraud by receiving money from clients in return for recycling hazardous waste containing toxic materials, but instead stockpiled them at warehouses. In addition, he faces one count of conspiracy for defrauding the IRS for non-payment and evasion of more than $850,000 in taxes.

If convicted by court, Shibilski faces a maximum penalty of five years imprisonment for illegal storage and disposal of hazardous waste, 20 years for each wire fraud charge and five years for tax evasion charge.
In related cases, another three persons who held positions with the company have been charged with conspiring to store and transport hazardous waste without the required permits. All have reached deals to plead guilty.
