SEATTLE (Scrap Monster): A federal judge of the Northern District of California, San Francisco has dismissed the lawsuit filed by Greenpeace against Walmart that accused the latter for using false plastic recycling labels. Greenpeace had claimed that Walmart used “recyclable” label for some of its household plastic products, when the option is not available for most of the consumers.

In her ruling, Judge Maxine Chesney noted that Greenpeace could not demonstrate that it has been misled by the alleged false advertising and that it lacked the necessary standing to bring its claims. She noted that the action taken by Greenpeace was in response to its belief that the challenged statements were false. The judge granted a deadline of October 15th to file a new, amended complaint.
Responding to the judgement, John Hocevar, Greenpeace USA Oceans Campaign Director said that that the ruling had effect on Walmart’s alleged conduct and that it will evaluate further legal options. The company has failed to take necessary action to address the actual issue, he added.
Meantime, spokesman for Walmart said that the company was pleased that the Court has dismissed the baseless lawsuit. The company relies on labelling developed and validated by its suppliers and sustainability partners, he added.
