These Terms of Use ("Terms") form a legally binding agreement between you and Scrap Monster, Inc. ("ScrapMonster", "we", "us", or "our"), a company incorporated in the Province of Quebec, Canada.
These Terms govern your access to and use of our websites, mobile sites, applications, tools, data feeds, APIs, directories, content, and related services, including scrapmonster.com, oilmonster.com, recyclingmonster.com, steelprices.com, scrapprices.com, currencymonster.com, and any other websites or platforms operated by ScrapMonster (collectively, the "Services").
By accessing or using the Services, creating an account, or clicking "I agree", you accept and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use the Services.
You must be at least eighteen (18) years old and legally capable of entering into binding agreements. The Services are intended primarily for commercial and industry participants, including scrap yards, brokers, recyclers, manufacturers, traders, and related businesses.
If you use the Services on behalf of a business or organization, you represent that you are authorized to bind that entity, and "you" refers to both you and that entity.
Certain features require account registration. You agree to provide accurate, current, and complete information and to keep it updated.
You are responsible for maintaining the confidentiality of your credentials and all activity under your account. You must promptly notify us of any unauthorized use. We maintain commercially reasonable safeguards, but we are not responsible for losses arising from unauthorized account access where you failed to protect your credentials.
The Services may include, without limitation:
ScrapMonster operates as an information and data platform. We do not buy or sell scrap materials and are not a broker or agent in third-party transactions.
Basic listings or profiles may be offered free of charge and remain subject to verification and compliance review.
Paid Services may include memberships, featured placements, shop purchases, API subscriptions, verification services, or other offerings. Fees and billing terms are disclosed at the point of purchase.
Certain enterprise or data licensing services may require execution of a separate Enterprise Data & API Addendum or written commercial agreement that defines permitted use, redistribution, and technical access rights.
Monthly memberships renew automatically unless canceled before the renewal date through the account dashboard or cancellation instructions provided at checkout.
Yearly or custom-term memberships renew only if expressly stated.You authorize ScrapMonster and its payment processors to charge your payment method for applicable fees. You agree to maintain accurate billing information.
Unless expressly stated in writing, all fees are non-refundable, including for partial billing periods, cancellations, or downgrades. Once Paid Services are delivered or made available, the associated fees are earned.
If you initiate a chargeback or payment dispute for valid charges, we may suspend or terminate access, remove listings or promotions, or pursue recovery of amounts owed, to the extent permitted by law.
The Services display content provided by third parties, including listings, prices, advertisements, and business profiles ("Third-Party Providers"). ScrapMonster:
Any transaction between users and Third-Party Providers is solely between those parties. ScrapMonster is not a party to such transactions and is not responsible for pricing, performance, quality, or disputes.
You agree not to:
We may remove content or suspend accounts where violations occur.
By submitting User Content, you grant ScrapMonster a worldwide, non-exclusive, royalty-free license to host, display, reproduce, modify, distribute, and promote that content as necessary to operate and market the Services.
You represent that your User Content is accurate, lawful, and does not infringe third-party rights.
We may review, edit, or remove content at our discretion.
All pricing data, indices, databases, methodologies, analytics, and related intellectual property are owned by ScrapMonster or its licensors.
Unless authorized by written agreement:
API access may be governed by separate agreements that prevail over these Terms where applicable.
Certain enterprise subscriptions, commercial data licenses, analytics access, or API services may be governed by additional agreements or addenda (including the ScrapMonster Enterprise Data & API Addendum). Where such an agreement applies, it supplements these Terms and will prevail in the event of any direct conflict with respect to the applicable enterprise services.
Prices, indices, charts, news, and analytics provided through the Services are for informational purposes only.
ScrapMonster prices reflect market indicators and index movements and may differ from local transactional prices paid by individual scrap yards or buyers.
The Services do not provide investment, trading, financial, or legal advice. You remain solely responsible for your business and trading decisions.
We may monitor platform activity, audit listings, and designate certain profiles as "verified" based on internal criteria. Verification does not guarantee accuracy, legitimacy, or regulatory compliance.
You may stop using the Services at any time.
We may suspend or terminate access where:
Termination does not entitle you to refunds for Paid Services already delivered.
All ScrapMonster content, excluding User Content, is protected by intellectual property laws.

You agree to indemnify and hold harmless ScrapMonster and its affiliates from claims or losses arising from:
The Services and all data are provided "as is" and "as available". To the maximum extent permitted by law, ScrapMonster disclaims all warranties, including merchantability, fitness for purpose, and non-infringement.
We do not guarantee uninterrupted access or data accuracy.
To the fullest extent permitted by law, ScrapMonster will not be liable for indirect, incidental, or consequential damages.

These Terms are governed by the laws of the Province of Quebec and the federal laws of Canada applicable therein.
You agree to the exclusive jurisdiction of the courts located in the judicial district of Montreal, Quebec, subject to any mandatory consumer protection rights that may apply.
We may update these Terms periodically. Continued use of the Services after updates constitutes acceptance of the revised Terms.
If any provision is unenforceable, the remaining provisions remain in effect. These Terms constitute the entire agreement regarding your use of the Services.
