Plastic Bag Ban to Take Effect From Dec. 14 in Boston

SEATTLE (Scrap Monster): The City of Boston is set to join other Massachusetts cities to ban single-use plastic bags. The City ordinance eliminating use of single-use plastic bags, passed in December last year, is set to take effect December 14, 2018. The key purpose of the ban is to reduce the use of disposable checkout bags by retail establishments and promote the use of reusable bags.

The ordinance bans carryout bag with handles provided by retail establishments to customers at point of sale. It excludes bags used to carry loose produce or products to check-out area, laundry bags, news paper bags and bags used to wrap produce, frozen foods, meat or fish. Meantime, retail establishments are allowed to provide reusable, recyclable or compostable bags to customers. However, these bags must be charged a minimum of five cents per bag. The fee thus collected can be retained by the retailer.

In case of determination of violation of the ordinance, the retail establishment shall be issued a warning notice. Additional violation within one year after a warning notice will result in a penalty of $50 for the first offence and $100 for the second and all subsequent offences. City officials said.

Meantime, the ordinance allows retailers to apply for temporary exemption from compliance for a period of one year by proving before the Chief of Environment, Energy and Open Space that the above said requirements would cause undue hardship to them.
