Plastic Bag Ban Bill Becomes Law in Washington

SEATTLE (Scrap Monster):  Washington State announced that Gov. Jay Inslee has signed Senate Bill 5323 into law.

The bill prohibits retail establishments from providing single-use plastic carryout bag, or a paper or reusable plastic carryout bag that does not meet recycled content requirements. Those retail establishments in areas without local ordinances could provide single-use plastic bags from existing inventory for a period of up to one year from the date of implementation of the ban.

The retail establishments are required to charge $0.08 per reusable plastic film bag or carryout paper bag until 31st December, 2025. Effective 1st January, 2026, the charge will increase to $0.12. The charge must be shown on the receipt provided to customers. A person using a voucher or electronic benefits card issued under WIC, SNAP, TANF, or FAP is exempted from the above charge. The violation of the requirements outlined in the legislation will invite penalty of $250.

The law pre-empts carryout bag ordinances enacted as of April 1, 2020 by local governments. Meantime, local ordinances that propose bag charge of $0.10 will not be pre-empted until January 1, 2026.

Meantime, the Governor is yet to take action on House Bill 2722 which mandates beverage manufacturers to use specified minimum post-consumer content in bottles.
