Court Rejected Lawsuit to Scrap Ban on Single-Use Plastic Bags

SEATTLE (Scrap Monster): The New York Department of Environmental Conservation declared that the ban imposed on plastic bags in the state would be reinstated with effect from October 21st. This follows the rejection of the lawsuit against the ban by the Supreme Court judge. It must be noted that the ban, which had come into effect in March this year, was delayed on account of the pandemic spread and the lawsuit filed by plastic bag manufacturers.

The Supreme Court judge upheld the state’s ban on single-use bags, stating that the lawsuit alleging regulations made on the ban as unconstitutional. At the same time, he set out a new regulation that recommends a minimum thickness for plastic reusable bags. The reusable bag manufacturers and business men pointed out that the new condition would prohibit distribution of reusable plastic bags and would limit the distribution to expensive cotton and paper bags.

The ban covers single-use plastic bags provided at the checkouts of grocery stores, convenience stores and superstores. Meantime, bags used for restaurant food delivery and those used for packaging items such as raw meat or produce are exempted from the ban.

The ban is expected to eliminate the use of approximately 23 billion single-use plastic bags per annum in the state.
