Ontario recycling company fined $65K for serious health and safety violations

SEATTLE (Scrap Monster): NexCycle Industries Ltd., 325 Orenda Road, Brampton, Ontario has been charged with a hefty fine after pleading guilty in the Court. A fine of $65,000 was imposed on the company, following the trial of an incident which took place in the facility in 2015, which resulted in amputation of a hand of one of its employees.

According to judgment by Provincial Offences Court, the company has been convicted for violating sections of the Occupational Health and Safety Act. The fine was imposed by the Justice of the Peace Darlene Florence in Brampton Court on July 11th. In addition to the $65,000 fine, the company will also have to pay additional 25% as victim fine surcharge, as required in accordance with the Provincial Offences Act. This payment will be credited to a special fund which will be used to provide assistance to victims of crime.

The incident which led to the hefty fine took place at the company’s Brampton facility on 3rd November, 2015. A worker, who attempted to clear a jam in the cardboard baler, put a hand into the machine. Unfortunately, the worker did not lock out the machine before doing so. The worker’s wrist was caught behind the ram of the machine. As a result, the employee’s hand was amputated. The court heard that the company failed to maintain safety precautions which resulted in permanent injury. It observed that the pinch point was not physically guarded.

Incidentally, Section 24 of Regulation 851: Industrial Establishments states that an in-running nip hazard or any part of a machine, device or thing that may endanger the safety of any worker shall be equipped with and guarded by a guard or other device that prevents access to the pinch point. NexCycle Industries Ltd. was cited for not properly guarding the operator side of the baler, which allowed access to the running machinery, thereby causing mishap. By doing so, the company also violated workplace health and safety rules as per Occupational Health and Safety Act, the court noted.

NexCycle Industries Ltd. is a recycling company that operates glass recycling facilities for Ontario's municipal blue-box collection. It is the central collection, separation and processing centre for The Beer Store and Ontario Deposit Return Programs. The 117,00 square foot Brampton facility processes over 300 million pounds of materials every year.
